1. Acceptance of Beta Terms

By accessing, downloading, installing, or using the Wisent beta application ("Beta App" or "Beta Service"), you agree to be bound by this Beta Program Agreement ("Agreement"), our Terms of Service, Privacy Policy, and End User License Agreement. If you do not agree to these terms, do not use the Beta Service.

Your participation in the Beta Program is entirely voluntary. You are choosing to use this pre-release software of your own free will, with full knowledge of the risks involved.

2. Nature of Beta Software

You understand and acknowledge that:

• The Beta App is pre-release software that is still under active development.
• Features may be incomplete, unstable, or entirely non-functional.
• The Beta App may contain bugs, errors, and defects that could cause unexpected behavior.
• The Beta App may crash, freeze, or become unresponsive without warning.
• Features may be added, modified, or removed at any time without notice.
• The Beta App is not intended for production use or mission-critical applications.

3. Things Will Go Wrong

During the beta period, you may experience:

• Data Loss: Your calendars, events, tasks, notes, and other data may be lost, corrupted, or deleted without recovery.
• Service Interruptions: The Beta App may become temporarily or permanently unavailable.
• Synchronization Failures: Data may fail to sync across devices or with third-party services.
• Incorrect Behavior: The app may not function as intended or documented.
• Performance Issues: The app may be slow, drain battery, or consume excessive resources.
• Breaking Changes: Updates may break existing functionality or require you to start fresh.
• AI Errors: AI-generated content may be inaccurate, inappropriate, or completely wrong.

You accept these risks as an inherent part of beta testing.

4. User Responsibility

You are fully responsible for:

• Your decision to participate in the Beta Program.
• Any actions you take based on the Beta App's functionality or outputs.
• Maintaining your own backups of important data.
• Verifying any information provided by the Beta App, including AI-generated content.
• Any consequences resulting from your use of the Beta App.
• Ensuring the Beta App is suitable for your intended use.

Do not rely on the Beta App for critical scheduling, important reminders, or time-sensitive matters. Always maintain alternative methods for managing important events and tasks.

5. No Warranty

THE BETA APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

Wisent expressly disclaims all warranties, including but not limited to:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties of accuracy or reliability
• Warranties of uninterrupted or error-free operation
• Warranties that defects will be corrected

6. Limitation of Liability

To the maximum extent permitted by applicable law, Wisent, its affiliates, officers, directors, employees, agents, and partners shall NOT be liable for any:

• Direct, indirect, incidental, special, consequential, or exemplary damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Beta App
• Damages resulting from any data loss or corruption
• Damages resulting from unauthorized access to your data
• Damages resulting from bugs, errors, or defects in the Beta App
• Damages resulting from reliance on AI-generated content
• Damages resulting from service interruptions or outages
• Any other damages arising from your participation in the Beta Program

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Wisent has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless Wisent and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Beta App
• Your violation of this Agreement
• Your violation of any applicable law or regulation
• Any claim that your use of the Beta App caused damage to a third party

8. Feedback and Bug Reports

We encourage you to provide feedback, bug reports, and suggestions. By submitting feedback, you grant Wisent a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your feedback into current or future products without compensation or attribution.

9. Beta Program Duration and Termination

The Beta Program is offered at Wisent's sole discretion. We reserve the right to:

• Modify, suspend, or discontinue the Beta Program at any time without notice
• Revoke your access to the Beta App at any time, with or without cause
• Transition the Beta App to a paid service or change pricing at any time
• Require acceptance of new terms to continue using the Beta App

Upon termination of the Beta Program or your access, you must cease all use of the Beta App and delete all copies from your devices.

10. Confidentiality

The Beta App and its features may be considered confidential information. You agree not to disclose non-public features, screenshots, or details about the Beta App without prior written consent from Wisent, unless such information has been publicly released.

11. No Support Guarantee

Wisent is not obligated to provide technical support, maintenance, updates, or bug fixes for the Beta App. Any support provided is at our discretion and may be discontinued at any time.

12. Governing Law

This Agreement shall be governed by and construed under the laws of the United States, without regard to conflict-of-law principles.

13. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

This Agreement, together with the Terms of Service, Privacy Policy, and EULA, constitutes the entire agreement between you and Wisent regarding the Beta Program and supersedes all prior agreements and understandings.
